Who uses the DC905 tax form?

The bankruptcy form has to be filled by a trustee on behalf of someone who is in bankruptcy or making a proposal. 

When should it be filled out?

You have to fill it out as soon as you receive the taxpayer’s number from the Office of the Superintendent of Bankruptcy. That way, the CRA can send the appropriate refunds and correspondence to the taxpayer. 

Do I have to include it with the taxpayer’s income tax return?

No, but you have to identify the return as pre-, in- or post-bankruptcy. If you want to receive the post-bankruptcy refund instead of the taxpayer, you need to attach an Authorization and Direction letter to the taxpayer’s T1 income tax return.

What else can I indicate on the form?

You can use the form to indicate if you have an interest in the taxpayer’s Goods and Services Tax Credit.  

How will the CRA get my address since I just put the taxpayer’s address on the form?

The CRA will obtain it from the Office of the Superintendent of Bankruptcy (OSB) Licensing Services.
