Contest Official Rules    

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON.

THIS CONTEST IS OPEN TO RESIDENTS OF CANADA ONLY (EXCLUDING RESIDENTS OF THE PROVINCE OF QUEBEC) AND IS GOVERNED BY CANADIAN LAW (OTHER THAN THE LAW OF THE PROVINCE OF QUEBEC).

Sponsor and Administrator (as defined below) will be collecting personal data about Participants online, in accordance with their privacy policies. Please review Sponsor’s privacy policy. By participating in the Contest, Entrants hereby agree to Sponsor’s and Administrator’s collection and usage of their personal information in accordance with these privacy policies and acknowledge that they have read and accepted Sponsor’s privacy policy. This Contest is void outside of Canada and in Quebec and where prohibited.

This Contest is sponsored by Intuit Inc., 5100 Spectrum Way, Mississauga, Ontario L4W 5S2 (the “Sponsor”).This Contest is administered by Citizen Optimum L.P., 33 Jefferson Avenue, Toronto, Ontario, Canada M6K 1Y3 (the “Administrator”). Any questions or concerns regarding the administration of the Contest should be referred to the Administrator (turbotax@citizenrelations.com).

Although the Contest shall be communicated, promoted or administered by means of a third party social media or social networking service or site (a “Third Party Service”), the Contest is not sponsored, endorsed or administered by, or associated with, any Third Party Service. Any questions, comments or complaints regarding the Contest should be directed to the Administrator and not to any Third Party Service.

  1. Eligibility:

No purchase necessary.

Open to legal residents of Canada who are located in Canada other than residents of the province of Quebec and are at least 18 years of age or older at the time of entry (“Entrant”). This Contest is governed by the laws of Canada (other than the laws of the province of Quebec) and is subject to all applicable federal, provincial, municipal, territorial and local laws, directives and regulations. Employees, officers and directors of Intuit Canada, 5100 Spectrum Way, Mississauga, ON L4W5S2 (“Sponsor”), its affiliates, Citizen Optimum L.P., Toronto, ON M6K1Y3  www.citizenrelations.com (“Administrator”), and each of their respective parents, affiliates, subsidiaries, advertising, promotion and fulfillment agencies (collectively, the “Promotion Entities”) and members of the immediate family or household of each are not eligible to participate. Immediate family member is defined as a parent, sibling or any person residing in same household as employee. This Contest is void where prohibited by law.

  1. Agreement to Official Rules:

These Official Rules govern the Contest. Participation constitutes Entrant’s agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and legally binding in all respects.

  1. Timing:

(a) There are three contests associated with this Contest, one in each of Twitter, Facebook and Instragram (each, a “channel”). The Twitter contest begins Monday, March 26, 2018 at 10:00 a.m. Eastern Standard Time (“EST”) and ends Sunday, April 1, 2018 at 11:59:59 p.m. EST. The consecutive Facebook contest begins Monday, April 2, 2018 at 10:00 a.m. EST and ends Sunday, April 8, 2018 at 11:59:59 p.m. The consecutive Instagram contest begins Monday, April 9, 2018 at 10:00 a.m. EST and ends Sunday, April 15 at 11:59:59 (each, a “Contest Period” and collectively the “Contest Periods“). Administrator’s computer server is the official time-keeping device for Contest and for each Contest Period.

(b) The Contest consists of certain prizes per channel. Potential winners will be randomly selected based on the schedule listed by the Administrator and set out below, from all eligible entries received prior to the relevant drawing.

(c) Potential winners will be notified by e-mail and/or by comment or Direct Message (as Administrator elects) using the contact information provided at the time of entry. A Direct Message (“DM”) is a private message sent directly to an Entrant. All DM replies must be sent to the Administrator’s Facebook, Twitter or Instagram handle within (48) hours of first attempted prize winner notification. Any additional communication to any potential winner by the Administrator will be by email.

Sponsor shall have no liability for any notification that is lost, intercepted or not received for any reason. If prize notification is returned as unclaimed or undeliverable, such potential winner will forfeit the relevant prize and at Sponsor’s discretion, an alternate potential winner may be selected. If any potential winner is found to be ineligible or if the potential winner has not complied with these Official Rules or declines a prize for any reason, such potential winner will be disqualified and at Sponsor’s discretion, an alternate potential winner may be selected.

Limit: one $1000 prize per person or household for the Contest. All entries per channel eligible for the Grand Prize for that channel.

  1. Prizes:

Only the prizes listed below will be awarded in this Contest. For each channel:

One Grand Prize of $1,000.00 awarded in the first drawing. Prize awarded in the form of a Visa gift card or a cheque (at the discretion of the Administrator), made payable to the winner.

Two Additional Prizes as Second and Third Prizes awarded in the second and third drawings. Each second and third winner will receive a product code to be used to file tax returns using TurboTax online. Prizes awarded in the form of a code which can be used to access TurboTax services online. The Approximate Retail Value (“ARV”) of each of these prices is $79.99. This prize can be used only online with TurboTax. These prizes must be used for the preparation of the winner’s 2017 tax return. There is no cash value or substitution of these prizes.

The total cash value of the first prizes is $3,000.00 and the ARV of the second and third prizes is about $480.00, for a total of $3,480.00 in prizes.  

Odds of winning depend on the number of valid entries received.  

Sponsor and Administrator will not replace any lost, mutilated or stolen prizes. Prizes are non-transferable, non-refundable and no substitutions will be made except as provided herein, in the Administrator’s sole discretion. Winner is responsible for any and all applicable local, province and/or federal taxes and fees.

  1. How to Enter:

You may enter this Contest via Sponsor’s Facebook, Instagram or Twitter handle. For an entry to be deemed eligible, during the relevant Contest Periods, you must comment on any of the following posts with a response to the question posted:

-Twitter post published at 10 a.m. ET on TurboTax Canada Twitter channel. (Response can be in the form of an @message or retweet and response. Must include #TTSmarterTogether in response, with a tag to a friend and follow @TurboTaxCanada.)

-Facebook post published at 10 a.m. ET on TurboTax Canada Facebook channel. (Response must be a comment in thread, with a tag to a friend and #TTSmarterTogether hashtag. Must be a fan of page.)

-Instagram post published at 10 a.m. ET on @TurboTaxCanada Instagram channel. (Response must be in the form of a comment, with a tag to a friend and #TTSmarterTogether hashtag. Must follow @TurboTaxCanada.)

Participants are eligible to win on any channel. To be eligible to win, they must be a fan/follower of TurboTax Canada on the respective contesting channels.

All friends who are tagged must be residents in Canada (excluding Quebec) with physical addresses in Canada (other than Quebec). The Entrant must have the consent of the friends who are tagged to their participation in this Contest, to providing Sponsor with their contact information and to Sponsor contacting them electronically. The Entrant will tag and send a comment including a friend when entering this Contest which may be reposted and accessible intermittently in the Contest Periods and for a period thereafter. By providing the names of friends, each Entrant warrants and represents that his or her friends consent to participation in this Consent as set forth herein, including, but not limited, to his or her name and contact information being posted or accessible at or through Sponsor’s channel sites.

BY SUBMITTING AN ENTRY YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND FULLY AGREE TO THESE OFFICIAL RULES. DO NOT SUBMIT AN ENTRY WITHOUT FIRST REVIEWING THESE OFFICIAL RULES. To be eligible for the Contest, posts must be submitted in compliance with the format and other requirements set forth on the channel where persons may submit entries (i.e., Twitter, Facebook and Instagram); such requirements being made a part of these Official Rules and incorporated herein by reference.

NOTE:

If your social media account (Facebook, Instagram and Twitter) is set to “protected mode,” or “private” your entry will not be visible and thus will not be received by Sponsor. Your entry method must be set to “public”.

Limit:  One (1) entry per person per day.

Entries in excess of any stated limitation and entries generated by script, macro or other automated means or any means that subvert the entry process will be void. All entries become the property of Sponsor.

Once a potential winner is confirmed as a winner, prize distribution will be promptly coordinated. Except as otherwise indicated by Sponsor, a winner must personally take delivery of the prize as instructed within thirty (30) days of being notified that such prize is available or within such other time period as may reasonably be advised. If a winner fails to take delivery of the prize as instructed, the prize will be deemed forfeited.

  1. Winner Requirements:

To be declared a winner, a potential winner:

  1. must correctly answer, without assistance, a time-limited, mathematical skill-testing question to be administered by Sponsor. without assistance of any kind (whether mechanical or otherwise) within a 2-minute time limit in order to win the prize. The question will be administered by DM or Email within two (2) business days from the drawing and if the winner selected cannot be contacted and/or the skill testing question cannot be administered, the prize will be forfeited and an alternate Entrant selected;
  2. must be in compliance with these Official Rules;
  3. must sign and return, within any designated time period, a release of liability and consent to publicity form and any other documentation as reasonably required; and
  4. may be required to provide proof of identification to confirm eligibility or to claim a prize, or provide proof that he or she is the authorized account holder of any account associated with the selected entry for the channel.

Acceptance of prize shall constitute winner’s agreement and consent to Sponsor’s and its designees’ use of winner’s name, city/province, likeness, photo (including, without limitation, Facebook profile photo), avatar, and/or prize information in connection with this Contest for promotional, advertising or other purposes, in any manner, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.

  1. Release:

By entering, you agree to release, indemnify and hold harmless the Promotion Entities, Facebook, Instagram, Twitter and its or their respective officers, directors, and employees  (the “Released Parties”) from and against any and all liability, claim or cause of action, including, but not limited to, injuries, death, loss or damage of any kind, arising from or in connection with this Contest and the operation and administration thereof, your participation in the Contest, or receipt or use or misuse of any prize. The Released Parties are not responsible in any manner for the winners’ participation in the TurboTax services

  1. General Conditions:

Sponsor reserves the right to cancel, suspend, and/or modify this Contest, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of this Contest, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine winner from among all non-suspect, eligible entries received up to time of such action or as otherwise deemed fair and appropriate by Sponsor. Administrator, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of this Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries. 

  1. Limitations of Liability:

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in this Contest; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or this Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of this Contest, the uploading, the processing or random selection of entries, the announcement of the prize or in any Contest-related materials; (5) late, lost, garbled, misdirected, inaccurate, incorrect, undeliverable, damaged or stolen entries or mail; (6) costs associated with claiming or redeeming the prizes; nor (7) loss or damages resulting from an Entrant’s connection to the internet via any of the websites contained herein.  The Released Parties are not responsible for any incorrect, mistranscribed, misdirected or undeliverable entries, email transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. The Released Parties assume no responsibility for late, lost, incomplete, inaccurate or damaged entries, or undeliverable E-mails resulting from any form of active or passive E-mail filtering by a user’s Internet service provider and/or E-mail client or for insufficient space in user’s E-mail account to receive E-mail. The Released Parties do not accept responsibility for any damage (whether material or non-material) caused to Entrants, to their computer equipment or to data which is stored on them, or to their personal, professional or commercial activities. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor or Administrator.

  1. GOVERNING LAW/JURISDICTION:

ALL ISSUES ABOUT AND CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR OR ADMINISTRATOR OR ANY OF THE RELEASED PARTIES IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE PROVINCIAL LAWS OF CANADA (OTHER THAN THE PROVINCE OF QUEBEC) WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER LAWS.

The laws of the province or territory (other than the province of Quebec) in which the Entrant resides apply to the Contest in respect of that Entrant. If any part of these Official Rules is legally unenforceable or inapplicable, then that part will be deemed invalid; however, the remainder of these Official Rules will otherwise continue to be legally binding. Rights and remedies may vary by province or territory.   

  1.   VENUE:

By participating in this Contest, each Entrant agrees that any and all disputes the Entrant may have with, or claims Entrant may have against, the Promotion Entities or the Released Parties relating to, arising out of or connected in any way with (i) the Contest, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement, will be resolved individually and exclusively in the courts of Canada.
